@IngaH hat dankenswerter weise den nachfolgenden Themenbereich erstellt, der auch mal vorkommen kann, fuer Faelle, in denen das I-130 noch vor dem I-129f (beim K-Visum) approved wird.

NVC Processing

In some cases, the I-130 petition may be approved before the K3 petition.

Once the I-130 petition is approved at the
USCISServiceCenter, the USCIS will forward your case to the NationalVisaCenter for processing. You will be notified of the approval by mail (Notice of Action / “NOA2”).

Processing the I-130 takes between 3 and 5 months at the National Visa Center (NVC) in
New Hampshire, plus about 4-6 weeks until the interivew in Frankfurt, Germany.


These are the steps at the
NationalVisaCenter:
  • The NVC assigns a new case number. (starting with “FRN” for the consulate in Frankfurt, Germany)
  • The NVC creates a form DS 3032 Choice of Agent and Address form, and the Affidavit of Support fee bill of $70 (for processing of form I-864).
  • The fee bill and a copy of the DS 3032 will be sent to the US spouse (=petitioner).
  • The original DS 3032 will be sent to the foreign spouse (=beneficiary).
  • The DS 3032 needs to be filled and signed by the foreign spouse. It is recommended by the NVC to name the US Citizen spouse as Agent. This Agent will receive all future mail from the NVC regarding this case.
  • The petitioner pays the Affidavit of Support fee bill ($70) to the St. Louis facility (as directed in the instructions).
  • Upon receipt of the Affidavit of Support fee, the NVC creates the I-864 Affidavit of Support package, and sends it to the US spouse.

Around the same time, after the receipt of the DS 3032, the NVC creates the Immigrant Visa Fee bill ($335 + $45) and sends it to the petitioner.
  • The I-864 form needs to be returned to the NVC in New Hampshire (with all requested material, as directed in the instructions)
  • The petitioner pays the Immigrant Visa fee bill ($335 + $45 security fee, since 03/2005) to the St. Louis facility (as directed in the instructions).
  • Upon receipt of the IV fee, the NVC creates form DS 230 Part I (Biographic Data). This form will be sent to the Agent (normally the US spouse) but needs to be filled out by the beneficiary (=you, the foreign spouse)! A photocopy of the biographic page of your (=the beneficiary’s) passport needs to be submitted with the DS 230 (as directed in the instructions).
  • Return the DS 230 to the NVC in New Hampshire (as directed in instructions).
  • Upon the receipt of form DS 230 the NVC will start the actual review of your case.
  • The review of the I-864 package usually takes between 4-6 weeks. In some cases, a so-called “RFE” (=request for further evidence) may occur. In that case, you (the agent/ petitioner) will be notified by mail about the missing or incomplete information. You submit the missing info, and the review starts over.
  • The review for the DS 230 usually takes between 1-3 weeks.
  • Once the case review is completed, the NVC will forward the case to the US consulate in Frankfurt.

Side Note: The NVC does accept UPS/ FedEx/ DHL deliveries! (Faster from overseas, usually 48 hours from door to door).

The
St. Louis facility (US Bank) does NOT accept those deliveries.



You can call the NVC at this number to follow your case: 1 603 334 0700. The automated response system is available 24 hours a day. Operator assistance is available from 7:30am until 8:45pm EST, Mon-Fri. You cannot follow your case progress online.

When you first call the NVC, choose options 1, then 1, then 1, and then punch in your CIS receipt number at the promt. If the case has been entered into the NVC system and has been assigned a case number, you will hear it now. (“FRN....”).

(--> allow about 2-4 weeks from NOA2 until new case number.)

On your next calls, choose options 1, then 1, then 2, and punch in your new NVC Case number at the prompt. You will then hear the news about your case (see steps described above).

Any questions related to the Affidavit of Support fee bill and form (I-864) can only be answered through an operator; there is no Affidavit of Support news on the automated system.

Once the completed petition arrives in
Frankfurt, an interview date will be assigned to you by this consulate, and you will receive a package of information, and form DS 230 Part II.

This package contains the interview date & time and also the required documents which you need to present at the time of the interview.

The instructions for form DS 230 also contain a complete list of things you need to obtain for your interview at the consulate in
Frankfurt, so you can get ready ahead of time.

The Medical results will be sent to the consulate by the physician. The results are valid for 1 year. The cost for the Medical Exam is € 125.

Police certificates can also be ordered ahead of time. Your German police certificate usually usually arrives 10-14 days from the time you ordered it. It costs € 13. Police Certificates should not be older than 6 months at the time of interview.

In some cases, the K3 Visa application is approved some time during the CR1 process:

The K3 Visa petition will also be sent to the NVC for a Frankfurt Case Number. It will be sent on to the Consulate in
Frankfurt within a few days, and you will receive “package 3” from Frankfurt then.

The approved K3 petition is valid for 1 year. So you may decide to hold back the “package 3” for a while to see the progress of your I-130 petition.

If you decide to persue the CR1 petition and abandon the K3, you may cancel your K3 petition with the Consulate (phone: +49-69-7535-0).

There are some advantages in awaiting the CR1 process:

You will receive the actual greencard only a few days/weeks after you enter the
US.

You are able to start working pretty much right away.

You are saving the time and money to go through Adjustment of Status processing.


You may also decide to persue the K3 visa and complete your CR1 process from the USA. You would then return “package 3” and follow the normal process. Then, there are 2 options:

  • You await the CR1 process through NVC in the USA and fly home for your interview at the consulate in Frankfurt.
  • You contact the USCIS when you are in the USA; they will obtain the approved I-130 petition from the NVC and then the usual “Adjustment of Status” process will start.
