Clinicial Negligence Update

Major damages award in brain injury cases

In the past 3 years we have successfully recovered awards of damages exceeding £20m for our clients who have sustained brain injuries either during their births or due to adverse treatment giving rise to lack of oxygen to their brains. Sternberg Reed continues to act for children and adults who have acquired brain injuries as a result of clinical negligence.

Mental Capacity Act 2005 and changes to the Court of Protection

When the Mental Capacity Act 2005 came into force in 2007 many changes came about specifically the change in structure to the Court of Protection and the creation of the Office of the Public Guardian. Procedures became more formal and as a result there has become a greater need for the involvement of lawyers.

John Bruty who is a member of our Clinical Negligence team and who has dealt with many cases where peoples injuries have prevented them from being able to handle their financial affairs, has been appointed by the Court of Protection as Deputy (formally known as a Receiver) for those people.
